Bharg Technologies GmbH ('we', 'us', or 'our') operates the Fortyfive mobile application ('Fortyfive' or the 'App'). This Privacy Policy explains how we collect, use, store, share, and protect your personal information in compliance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR).

  • Location Data: with your consent, precise or approximate location data to enable location-based matching for face-to-face meetings.
  • Device Information: device type, operating system, IP address, and unique device identifiers.
  • Usage Data: how you interact with the App, including pages visited, features used, and time spent on the App.
  • Cookies and Tracking Technologies: cookies and similar technologies (e.g., pixels) to improve functionality, analyze usage, and personalize your experience.

1.3 Data from Third Parties

  • Social Media Login: if you log in via third-party services (e.g., Google, Apple), we may collect limited information, such as your email address or profile details, as permitted by those services.
  • Third-Party Analytics: we use third-party analytics providers to understand App usage (e.g., Google Analytics).

2. How We Use Your Information

We use your personal data for the following purposes:

  • To Provide and Improve the App: facilitate user matching based on location, age, and availability; enable connection requests and in-App chat functionality; personalize your experience and recommend relevant users to meet.
  • To Communicate with You: send notifications about connection requests, messages, or App updates; respond to your inquiries or customer support requests.
  • To Ensure Security and Compliance: verify user identities and prevent fraudulent activity; enforce our Terms of Use and ensure compliance with applicable laws.
  • For Analytics and Improvement: analyze usage trends to improve App functionality and user experience.
  • For Marketing (Optional): with your consent, send promotional offers or newsletters about the App or related services.

3. Legal Basis for Processing

Under the FADP and GDPR (where applicable), we process your personal data based on the following legal grounds:

  • Consent: for location data, marketing communications, and certain optional features.
  • Contractual Necessity: to provide the App’s core services, such as matching and chat functionality, as part of your agreement with us.

  • With Other Users: your profile information (e.g., name, age, photo) is visible to other users based on your privacy settings to facilitate matching and communication.

Users may request deletion of their account and associated data by submitting a request through our designated account deletion form or by contacting us at hello@fortyfive.app. We will respond within 30 days, as required by law.

8. International Data Transfers

As a Swiss-based company, your data is primarily stored and processed in Switzerland, which is recognized as providing adequate data protection under the GDPR. If we transfer data to countries outside Switzerland (e.g., to third-party service providers), we ensure appropriate safeguards, such as:

  • Contracts with data protection commitments.

9. Children’s Privacy

The Fortyfive App is not intended for users under 18 years of age. We do not knowingly collect personal data from children under 18. If we become aware of such data, we will delete it immediately.
